The Madison Metropolitan Sewerage District (MMSD) Commission unanimously adopted comprehensive revisions to its Sewer Use Ordinance (SUO) on June 25, stepping back from proposed strict chloride reduction mandates after significant pushback from customer communities. The regulatory compromise comes as the District simultaneously fights tightening environmental standards at the state level. During the meeting, Legal Counsel Vanessa Wishart announced that the District was granted a contested case challenge against the Wisconsin Department of Natural Resources (DNR) regarding strict new chloride and Whole Effluent Toxicity (WET) limits in its latest wastewater permit. The contested case, filed on June 4, stays the new permit terms—which included a year-round chloride limit of 408 mg/L—and allows MMSD to operate under its prior permit limits while the challenge is resolved. At the local level, the District had originally drafted its 2026 SUO update to require customer communities to enforce strict water softener efficiency standards. The proposed rules would have mandated that softeners meet a 4,000 grain-per-pound salt removal efficiency and utilize technologies like blending valves or brine reclamation. Water softeners represent the largest contributor of chloride to the District's wastewater system. However, the proposal drew sharp criticism from member municipalities, including the cities of Madison, Monona, Middleton, and Fitchburg, as well as the Village of Windsor. In written comments submitted prior to the meeting, municipal public works officials argued the mandate would be a logistical impossibility. The City of Madison noted that enforcing the standard would require inspecting approximately 80,000 parcels, a programmatic undertaking that could take "decades to fulfill." The City of Monona similarly stated it lacked the staff and budget to ensure compliance. In response, MMSD staff revised the final SUO language to focus on education and the voluntary "consideration" of source reduction measures, rather than mandatory implementation. Despite the immediate rollback, District staff warned that customer communities should prepare for more prescriptive requirements in the next SUO update, which will be drafted following a dedicated stakeholder engagement project beginning later this year. Staff emphasized that reducing chloride at the source remains the most cost-effective means of achieving long-term compliance with the District's permits. In other business, the Commission approved a $181,300 contract with ConsultAdd for business analysis services related to the District's Workday enterprise resource planning (ERP) implementation, and formally accepted the completed Flow Splitter Improvements project. The final construction contract with August Winter & Sons, Inc. totaled $6.16 million, bringing the total project cost to $6.98 million—approximately $620,000 below the authorized budget.
