Niagara launches water utility options review, keeps corporatisation decision on holdNiagara Region Council has voted to advance an options analysis of water and wastewater delivery models in coordination with area CAOs. The approved direction does not establish a corporation or alter ownership of services, but puts a municipally owned utility model under formal examination.

Council carried an amendment directing staff to undertake an options analysis with the area CAOs' working group and to report back in 2027.

The analysis is expected to address governance, public ownership, asset and debt implications, capital financing, rate impacts, regulatory requirements and implementation issues.

Council stipulated that no corporation, asset transfer, or change in the ownership or delivery of water and wastewater services can occur without further Regional Council approval.

Deloitte told councillors that more than one-third of Niagara's water and wastewater assets were rated poor to very poor in the Region's 2025 Corporate Asset Management Plan.

Niagara Region Council has moved from an initial briefing on utility corporatisation to a formal review of alternative water and wastewater delivery arrangements, approving a direction to undertake an options analysis alongside the area CAOs' working group. The motion was carried after debate over whether a lame-duck council should set the process in motion ahead of municipal elections. It directs work on potential governance and delivery structures, with public ownership identified as a desired outcome. Council also made clear that the exercise itself does not approve formation of a corporation, transfer of assets, or any change to ownership or delivery of water and wastewater services. Any such action would require a further Council decision. The review follows a presentation by Deloitte LLP on Ontario's available models: Niagara's existing departmental structure; a locally established municipal services corporation (MSC); and a provincially enabled water/wastewater public corporation (WWPC) under the Water and Wastewater Public Corporations Act of 2025. Deloitte said an MSC would remain municipally owned, but would operate as an arm's-length corporation governed by a board. The model could use utility rates, corporate debt, retained earnings and shareholder support, rather than having all borrowing sit within regional borrowing limits. Under the current departmental structure, Council has direct oversight of operations, budgets, rates and service levels. The consultant said the newer WWPC pathway remains an emerging provincial model, with key operational details still unresolved. As currently outlined, rate approval under a WWPC could sit with its board or the province rather than Council. Deloitte also cautioned that existing long-term water and wastewater debt is not currently intended to transfer to a WWPC, potentially leaving municipalities to service debt without the associated revenues. The case for examining alternatives rests partly on Niagara's asset and financing pressures. Deloitte cited the Region's 2025 Corporate Asset Management Plan, under which more than one-third of water and wastewater assets were rated poor to very poor. It also cited a regional debt-to-revenue ratio of about 61% in 2025, while Niagara's population is projected to reach about 694,000 by 2051. The CAO said staff are developing a scope of work and request for proposals for the broader service-delivery review. That work will first examine the existing two-tier split of assets and responsibilities between the Region and local municipalities, including the implications of retaining or changing that arrangement. The CAO said external financial, engineering and legal expertise would be required, with the work intended to remain public. The Council direction anticipates the options analysis returning in the second quarter of 2027, including results, costs and timing for any subsequent work, potential provincial approvals or legislative changes, and a recommendation on whether to proceed to a detailed business case.
