City Council unanimously approved Ordinance 2026-42, amending the city's water-sewer utility rates and rights.

Officials confirmed a three-year look-back period allows the city to retroactively increase connection fees if commercial water usage exceeds initial engineering estimates.

The utility director clarified that general recovery costs for increased pumping, energy, and chemical usage are spread evenly across all customer classes.

Currently, the prospective data center discussed at the meeting draws no water from the city system.

The Vineland City Council voted 5-0 on June 23, 2026, to adopt Ordinance 2026-42, amending the municipal water-sewer utility rates following a public hearing dominated by concerns over the potential water demands of a new data center. During the public comment period, resident Matt Williams questioned whether infrastructure upgrades required to serve massive commercial water requests—including potential new wells or PFAS filtration systems—would financially burden average ratepayers. Williams cited external research indicating that standard water calculation methods often misrepresent data center water usage. City officials responded by detailing the utility's connection fee mechanisms designed to insulate residential customers from corporate infrastructure costs. An official addressed the council, explaining that infrastructure for large commercial users is funded directly through connection fees based on projected gallon usage. "We have a three-year look-back period," the official noted. "So if they come in with their engineering and say we're using 20 million gallons a year and we found that they're using 40, we can automatically increase the connection fee, which covers the cost of the infrastructure. So that's not passed on to the residents." Utility Director Dennis further clarified the distinction between connection fees and general recovery costs. While connection fees establish the infrastructure foundation for large end-users, recovery costs—which cover increased energy and chemical expenses during periods of high pumping, such as droughts—are distributed evenly across all customer classes. "The recovery cost will be spread evenly across everything. It's not based upon one using more than the other," the director stated, adding that the data center in question currently utilizes zero water from the city. The director also provided context on the utility's rate tiers, noting that a standard one-inch service allows up to 10,000 gallons per month. While highly discounted rates are available for usage exceeding 2.5 million gallons a month, the utility currently only has about two customers reaching that volume. Following the discussion, the council—comprising Dr. Arthur, Council Member English, Council Member Vargas, Vice President Gomez, and President Spinelli—unanimously approved the ordinance.
