Separately, the utility secured $9.5 million in state capital outlay funding for near-term water treatment plant improvements.

The Sewerage and Water Board of New Orleans (SWBNO) is preparing for a major structural shift following the passage of House Bill 1243, legislation that will transfer significant administrative oversight of the utility to the New Orleans City Council. Set to take effect on August 1, 2026, the bill removes previous provisions dictating the board's composition from state law, empowering the city council to govern board appointments via local ordinance. To manage the overhaul, the mayor's office has issued an executive order creating the Public Utility Modernization Process Subgroup (PUMPS). This advisory think tank will assist in the immediate implementation of HB 1243 and evaluate a longer-term transition to integrate SWBNO into a local control model. During a June 9 governance committee meeting, SWBNO's Office of Special Counsel presented a transition assessment to address operational and financial risks associated with the change. Assistant Special Counsel Theron Levi-Backe confirmed that the legislation includes non-impairment language protecting all existing contractual obligations. "This extends to bond covenants, contracts related to grants or funding agreements, infrastructure projects, our public works construction contracts, or contracts for services," Levi-Backe noted. He added that the utility's professional services procurement policies, which align with city standards, are also expected to remain secure. Committee Chair Courtney Scrubbs highlighted the critical need to maintain operational stability as the region enters a high-risk hurricane season. Legal staff confirmed that the utility's statutory authority to issue emergency declarations and bypass standard procurement delays for emergency response remains untouched by the legislation. All necessary emergency service agreements for the current hurricane season are already secured. In a separate legislative update, Chief of Staff Jamie Parker reported additional policy and funding wins for the utility. SWBNO secured $9.5 million in state Priority 2 capital outlay funding for water treatment plant improvements. The funding will target filter improvements, lime storage, and river intake piping, pending authorization from the State Bond Commission. Furthermore, the utility successfully advanced a statewide constitutional amendment to allow the use of public funds for lead service line replacements on the customer-owned portion of private properties. The measure, which will appear on the November ballot, is accompanied by companion legislation that allows municipalities to execute the replacements without delay once property owners grant right of entry.
