The City of Atlanta is actively negotiating with the US Environmental Protection Agency (EPA) to potentially conclude or modify its long-standing federal consent decree, a move that could free up hundreds of millions of dollars for urgent water infrastructure needs. Speaking before the City Utilities Committee on January 27, 2026, Commissioner Irely described the utility’s performance under the decree as "remarkable," noting that the city has reduced sanitary sewer overflows (SSOs) to 3.4 per 100 miles, well below the national average of 4.5. With compliance costs rising exponentially for marginal gains, the Department of Watershed Management is seeking a "collaborative solution" with regulators. Atlanta is operating within a widespread regulatory framework—the EPA has taken enforcement action against approximately 92% of the nation's largest wastewater systems—yet recent modifications to decrees in jurisdictions like Seattle and King County suggest federal openness to adjusting timelines and reprioritizing infrastructure goals. "If we are able to just finish the projects we're working on now... it could free up potentially $600 to $700 million that's encumbered towards the consent decree to be reinvested in other parts of the utility," Irely told the committee. The proposed strategic pivot comes as the city faces challenges on the drinking water side. Irely highlighted a sharp disparity in capital spending, noting that while over $600 million is currently tied up in consent decree projects, investment in water distribution has been "less than $60 million," a ratio of more than ten-to-one. This imbalance has contributed to a 122% increase in water main breaks compared to the rolling average, a spike Irely attributed to both seasonal cold weather and the need for structural renewal. "You’ll see this in the quarterly briefing... what you're seeing is symptomatic of chronic underinvestment in multiple parts of the utility," Irely said, responding to council questions regarding rising emergency repair costs. "Our breaks will continue to increase until we substantially invest in our water infrastructure." During the meeting, the committee approved a $7.5 million amendment to an existing storm sewer improvement contract, effectively doubling the funding to $15 million to handle emergency repairs and upgrades. Council member Alex Wan questioned the procurement planning that necessitated such a rapid increase less than a year after the original contract, to which Irely cited the "unanticipated O&M and unanticipated capital repairs" resulting from the historic lack of investment outside the consent decree. Regarding the negotiations with the EPA, Council member Wan asked if the city was seeking an extension, a reduced scope, or a full declaration of compliance. Irely confirmed that "all of those are in play." The Commissioner emphasized that while the current decree technically requires zero overflows—a standard he noted is impossible for any utility—the city believes it has met the spirit of the agreement. Future investment is expected to prioritize water treatment plants and distribution piping to "flatten the curve" of main breaks. "We are going to be in a continual path of replace, rehab and redesign in the utility forevermore," Irely concluded.
