Pinellas County, Florida, is grappling with the legacy of pre-1990s urbanization and escalating storm impacts, driving a massive pipeline of stormwater capital needs that is increasingly running into private property roadblocks. During an April 2, 2026, work session, Public Works Director Kelly Hammerleavy outlined the county's active $277 million stormwater Capital Improvement Program (CIP). The portfolio of 24 active projects is heavily leveraged, supported by $87 million in grants as well as the local "Penny for Pinellas" sales tax. However, the active CIP represents only a fraction of the county's long-term infrastructure needs. Based on 19 completed watershed plans developed in partnership with the Southwest Florida Water Management District (SWFWMD), the county has identified 383 potential capital projects with a planning-level cost exceeding $1 billion. The county's flooding challenges are deeply tied to its historical development. Hammerleavy noted that the state did not begin regulating stormwater until 1982, and the county did not require large residential developments to manage stormwater on-site until 1990. By that time, the majority of the county's urban footprint was already built. This legacy left the county with constrained, channelized creeks that experience massive peak flows during storms. During Hurricane Milton, one local creek's flow violently surged from 2.5 cubic feet per second (cfs) to 466 cfs in less than a day. To address these systemic issues, the county is advancing several major initiatives. In the Joe's Creek watershed, a restoration project will strategically widen banks and upsize culverts to mitigate erosion and remove 14 buildings from the floodplain. At McKay Creek, the county is designing an operable lake structure to remotely draw down the Walsingham Reservoir and Taylor Lake ahead of major storms. Meanwhile, in the Cross Bayou area, the county is developing a regional stormwater facility designed to generate a bank of stormwater credits that developers can purchase if they cannot meet treatment requirements on-site. Despite the availability of funding and comprehensive watershed modeling, the county's public works department is facing severe logistical hurdles regarding private property rights. Because much of the area was platted before modern regulations, many major drainage conveyances are privately owned by homeowners' associations (HOAs) or commercial entities, with no easements dedicated to the government for maintenance. Hammerleavy revealed that the county recently had to cancel two capital projects because private property owners refused to grant access for necessary channel widening and culvert improvements. These refusals create hydraulic bottlenecks that exacerbate flooding in adjacent communities. The blockages prompted frustration from the Board of County Commissioners, who indicated a willingness to explore aggressive interventions. Commissioner Kathleen Peters suggested the county may need to seek state legislative action to prevent single property owners from blocking regional watershed improvements. The County Attorney's office noted that while eminent domain for property takings is a lengthy process, the county could potentially pursue legal injunctions to force property owners to comply with existing, though often ignored, private maintenance obligations for the drainage systems on their land.
