The applicant planned to offset impacts by purchasing 0.19 mitigation credits from the TM ECON Mitigation Bank Phase 4.

Vice Mayor Kelly Martinez Semrad voiced strong opposition to further wetland filling in the Econ Basin, attributing state-wide flooding to the irresponsible filling of wetlands.

Orange County Commissioners have delayed a decision on a standard environmental permit for a proposed 55-lot subdivision after raising significant concerns over wetland impacts and stormwater management in the Econ Basin. The board voted unanimously during its August 4 meeting to continue the hearing for Standard Permit SP-24-10-012 to September 15, directing the applicant, M/I Homes of Orlando, LLC, to reconsider the site plan to avoid wetland impairment. The developer sought the permit to establish a positive outfall for a stormwater pond, which would require 0.08 acres of Class II direct wetland impacts and 0.39 acres of Class III surface water impacts. The plan also included 0.54 acres of secondary Class II impacts, while preserving 0.91 acres of Class II wetlands on-site. To offset the disruption, the developer proposed purchasing 0.19 mitigation credits from the TM ECON Mitigation Bank Phase 4. Despite the county's Environmental Protection Division determining that the mitigation adequately offset the proposed impacts, commissioners balked at the loss of natural flood buffers. Commissioner Nicole Wilson cited the erosion of natural absorption features in the Econ River Protection Area, noting that the loss of such features becomes "abundantly clear following a catastrophic storm event." Wilson stated she was not comfortable with the potential impacts of future storms on nearby residents and opposed the permit as presented. Vice Mayor Kelly Martinez Semrad echoed the refusal to compromise the basin's hydrology, explicitly rejecting the strategy of filling wetlands deemed to have a lower ecological grade. "I don't believe that we should continue filling in because something has a lower grade quality. In my world, it means that we should be working to improve it instead of filling it in," Semrad said. "If we had followed a strategy like that, I don't think that we would be in the state of Florida where we continue to perpetually flood in ways that we have never flooded before. It's because we have irresponsibly filled in our wetlands." Semrad urged the developer to amend the subdivision plan so that it would not impact any wetlands in the Econ Basin. The delay will allow the developer to meet with county staff and local residents to explore alternatives for the stormwater outfall before the board reconsiders the permit in September. In a separate consent vote earlier in the meeting, the board authorized the issuance of Water and Wastewater Utility Revenue Bonds, Series 2026, and approved multiple task authorizations for stormwater and water supply facility engineering services.
