Residents cited severe flooding risks from a 40-foot topographic drop on the property and expressed skepticism regarding the placement and efficacy of the retention ponds.

The Board rejected the settlement in a 3-2 vote, leaving the developer to consider further litigation, administrative hearings, or alternative development plans.

A controversial settlement agreement that hinged on significant stormwater and wastewater infrastructure upgrades was denied by the Lake County Board of County Commissioners in a 3-2 vote on April 7. The settlement stemmed from a Land Use Dispute Resolution action filed by developer KB Home Orlando LLC after the Board initially denied a rezoning request for the 79-lot Crescent Pines subdivision in November 2025. To resolve the dispute, the developer proposed enhanced infrastructure commitments, specifically targeting stormwater management and wastewater treatment. To address severe topographical challenges—including a 40-foot elevation drop across the 40-acre site—project engineer Chuck Hyatt stated the developer committed to holding the entire 100-year, 24-hour storm event with zero discharge. This design required a 25 percent increase in retention pond sizes. "That's over and above what the county and the water management district requires currently," Hyatt told the Board. "If anything changes, gets adopted by the county or the water management district prior to us being developed, we will meet those rules." For wastewater, the developer planned to utilize Distributed Wastewater Treatment Systems (DWTS) instead of connecting to a regional sewer plant or using traditional septic tanks. An applicant representative clarified to the Board that the DWTS would consist of individual, underground advanced treatment systems for each lot, offering a higher degree of nutrient removal than standard septic. The representative explicitly noted there would be no central collector or lift station that could result in odor issues for the surrounding community. Despite these infrastructure concessions, neighboring residents overwhelmingly opposed the settlement. Multiple residents cited recent property flooding during Hurricane Milton and argued that the proposed retention ponds were poorly situated relative to the site's natural downhill flow. Richard Fisher, a local landscape designer, warned the Board that clearing the site's existing planted pines would result in devastating sheet flow across the slope, rendering the retention ponds ineffective. Following the public hearing, commissioners expressed lingering concerns regarding the adequacy of the stormwater engineering to handle major storm events and the overall compatibility of the subdivision's density with the surrounding area. The 3-2 vote to deny the settlement agreement leaves the Crescent Pines project in limbo. The developer may now choose to resume the administrative hearing process, pursue a Bert Harris Act claim against the county, or develop the property under its existing "by-right" entitlements, which currently allow for up to 49 residential lots without requiring a planned unit development rezoning.
