The Desert Water Agency (DWA) Board of Directors voted on July 21, 2026, to award the construction contract for Phase 2 of the Avenida Caballeros 30-inch Pipeline Project to Downey Construction for $1,156,156. The decision came after the board rejected the initial lowest bid following a formal protest, a scenario the agency expects to see more frequently due to new technology. The project involves installing approximately 618 lineal feet of 30-inch ductile iron pipe beneath the Barista flood control channel in Palm Springs, California. Construction is expected to be completed within 120 days of commencement. The total estimated cost for this phase, including agency labor, materials, overhead, and third-party inspections, is roughly $1.35 million. This falls within the $1.5 million remaining budget for the $3.945 million capital project. DWA received five bids for the project on June 18. Following the public bid opening, apparent low bidder TBU Inc. faced a formal bid protest from Downey Construction. DWA staff reviewed the protest and TBU's bid package, determining that it contained irregularities and omissions that rendered the bid non-responsive. The procurement dispute prompted DWA's legal counsel to highlight a shifting landscape in municipal bidding. Counsel informed the board that contractors are increasingly using artificial intelligence software to scan competitors' bids for errors to disqualify them. "We are seeing too that some firms are running their bids through AI and then they're running others' bids through AI," the agency's legal counsel stated during the meeting. "I wouldn't be surprised if we just see more of this type of stuff going forward. AI is going to make this potentially more common depending on how closely people pay attention." Downey Construction, whose bid came in approximately $40,000 below the engineer's estimate, was subsequently deemed the lowest responsive bidder. The board unanimously approved the contract award.
