The appeal, brought by downstream neighbors, focused heavily on the adequacy of the project’s stormwater drainage design and the legal right to install sewer and stormwater infrastructure within a shared private roadway. The appellant raised alarms over the project's plan to discharge approximately 6.7 cubic feet per second of stormwater—equivalent to roughly 3,000 gallons per minute—into Calle Frescota and La Jolla Shores Drive. Anna Ludke, an attorney representing the appellant, cited findings from a third-party water resources engineer who identified multiple alleged deficiencies in the developer's stormwater management plan. Specific engineering concerns included a brow ditch along the western boundary that bypassed a mitigation basin, potentially undermining water quality treatment and Q100 (100-year flood) mitigation. The appellant also pointed to an undersized biofiltration basin, inadequate freeboard for Q100 ponding, and the omission of hydraulic sizing and inlet capture analysis for a proposed 12-inch PVC storm drain. Beyond engineering, the appeal challenged the developer's authority to install private drainage and sewer facilities in Calle Frescota. City project manager Veronica Davison clarified the city's regulatory stance: an original 1949 grant deed allows for the "installation, repair, and replacement of public utilities" within the right-of-way. Davison noted that private sewer laterals and stormwater infrastructure connecting to public utility systems constitute allowable uses under this easement, which is customary practice. Applicant architect Brian Will and civil engineer Daniel Valdez defended the design, noting the site utilizes biobasins to capture east-to-west drainage before routing excess flows to a public curb outlet. Ultimately, Council President LaCava moved to deny the appeal, but only after city staff introduced strict modifications to the project's permits. The council approved the project with a revised engineering condition addressing the drainage study, two new public utilities conditions for sewer facilities, and a tentative map condition ensuring drainage and sewer improvements comply with state civil code requirements.
